Does Fenix Store comply with NDAA Section 889 (covered telecommunications equipment) for government purchases?Updated 36 minutes ago

Short answer

Yes — Fenix Light Store LLC (Fenix Store) does not use covered telecommunications equipment or services, or any equipment/system/service that uses covered telecommunications equipment or services, as defined under Section 889 of the FY2019 National Defense Authorization Act (NDAA).

In most cases you won't need us to fill out a separate 889 form, because our 889 representation is already on file as part of our SAM.gov registration:

Background: what Section 889 covers

Section 889 of the 2019 NDAA prohibits federal agencies (and, for Part B, any recipient of federal funds, including via a government purchase card) from doing business with a vendor that uses "covered telecommunications equipment or services" as a substantial or essential component of any system, or as critical technology as part of any system. "Covered telecommunications equipment or services" specifically means equipment or services produced/provided by:

  • Huawei Technologies Company
  • ZTE Corporation
  • Hytera Communications Corporation
  • Hangzhou Hikvision Digital Technology Company
  • Dahua Technology Company
  • (or any subsidiary or affiliate of the above)
